Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Vocablymobile application, website, and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Educational purpose

Vocably is designed to support vocabulary building, language learning, revision, and related educational habits. The Service is provided for general educational and informational purposes only. We do not guarantee fluency, exam results, academic outcomes, or any particular learning progress.

2. Eligibility

You must be at least 13 years old, or the minimum age required to consent to digital services in your jurisdiction, to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and accepted these Terms where required by applicable law.

3. Accounts and account security

Some features may require you to create an account. You agree to provide accurate information, keep your login credentials secure, and promptly notify us if you suspect unauthorized access to your account. You are responsible for activity that occurs through your account to the extent permitted by law.

4. License to use the Service

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use only.

5. Acceptable use

You agree not to:

  • use the Service in violation of applicable law
  • copy, reproduce, sell, or exploit the Service without permission
  • reverse engineer, decompile, or attempt to extract source code
  • scrape, harvest, or systematically collect data from the Service
  • use bots, crawlers, or automated tools to access the Service
  • interfere with security, performance, or normal operation
  • upload unlawful, infringing, abusive, or misleading content
  • use the Service to build a competing product or dataset

6. Subscriptions and billing

Certain features may require a paid subscription. Subscription purchases, renewals, cancellations, billing, and refunds are generally handled by the Apple App Store, Google Play, or another authorized payment provider. Their terms and policies may also apply. We may change pricing or subscription features to the extent permitted by law.

7. User content

The Service may allow you to create or submit content such as saved words, notes, learning lists, quiz responses, or support messages. You retain ownership of content you submit, but you grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display that content solely as needed to operate, maintain, improve, and support the Service.

8. Intellectual property

The Service, including its software, design, branding, text, graphics, lesson structures, and related materials, is owned by or licensed to us and is protected by applicable intellectual property laws. Except for the limited license above, no rights are granted to you.

9. Third-party services

The Service may integrate with third-party services such as app stores, analytics providers, authentication providers, or payment processors. We are not responsible for third-party services, and your use of them is subject to their own terms and policies.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is," "as available," and without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, or suitable for your particular goals or study needs.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, or other intangible losses arising out of or related to your use of the Service. To the extent liability cannot be excluded, our total liability for claims relating to the Service will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid to us for the Service in the 12 months before the event giving rise to the claim.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party rights.

13. Termination

We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, fail to pay applicable fees, or create risk for us, the Service, or other users.

14. Changes to the Service and Terms

We may modify, update, or discontinue parts of the Service at any time. We may also update these Terms from time to time. Continued use of the Service after updated Terms become effective means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict of laws principles, except where applicable law requires otherwise.
